CA drives home hands-free cell law Print E-mail

Take note California SUV-drivers with cell phone-clad cheeks: Hands-free kits as mandatory for all but commercial drivers may soon become law, with a bill expected to be signed by the Governator on Friday.

Never mind that the fine, $20, is a the cost of driving a few extra miles in a Hummer or Escalade -- it's the law starting in 2008.

Imagine it: city pedestrians crossing safely and suburban drivers dreaming of a day when a wave-in for lane change beats the old speed-up. But the editors of the San Francisco Chronicle, known for their wisdom, say it is a highlight of the legal hooey coming out of Sacramento -- no research to support it, they say.

Really? Tell that to someone who has not been cut-off on the road or nearly run over as a pedestrian by the cell phone-driver set, or to those who have talked back to us on The Ten Commandments of cell phone etiquette.

For the past six years, Sen. Tracey Eide, D-Auburn, has been trying to pass a bill in Washington against hand-held cell phone driving, which would make ours the third state to do so.

Last session, Eide's bill didn't even get a hearing in the transportation committee she sits on, even though she got the support of two wireless companies: Cingular and Verizon Wireless.

But the tide may be turning.

Seeking to minimize dangerous driving, some firms ban employees from talking on a wireless handset.

Wireless cell phone usage policies are increasingly being put in place, not only to reduce possible employee cell phone abuse but also to reduce corporate liability in the event the worst-case scenario happens.

On March 8, 2000, 15-year-old Naeun Yoon was walking along a highway in Northern Virginia when she was struck and killed by a car driven by Jane Wagner, an attorney at high-tech law firm Cooley Godward. Wagner was on her cell phone with a client at the time.

Wagner, who says she thought she hit a deer, turned herself in when she saw the news the next morning and realized what she did. She lost her license to practice law, served a one-year jail term in a work-release program and declared personal bankruptcy soon after her conviction.

Gov. Schwarzenegger Signs Bill Requiring Drivers to Use Hands Free Devices While Talking on a Mobile Phone

Gov. Schwarzenegger signed SB 1613 by Sen. Joseph Simitian (D-Palo Alto) that would prohibit the use of a cell phone in a moving vehicle unless the driver is using a hands free device.
 
“The simple fact is it’s dangerous to talk on your cell phone while driving. CHP data show that cell phones are the number one cause of distracted-driving accidents,” said Gov. Schwarzenegger. “So getting people’s hands off their phones and onto their steering wheels is going to make a big difference in road safety. The ‘Hands-Free’ cell phone bill will save lives by making our roads safer. I want to thank Senator Simitian for authoring this bill and for his commitment to the safety of his fellow Californians.”
